Objective: To evaluate moral development as an indicator of the capacity to consent among two groups of patients from the Hospital de Clínicas in Porto Alegre, RS, Brazil.Method: Fifty-nine adolescents and 60 patients over 60 years of age participated in a cross-sectional study to assess moral development using Loevinger’s model of ego stages.Results: Age and moral development showed no association, with most participants in the two groups being in the conscientious phase.Conclusions: Age is probably not an adequate variable to measure (...) decision-making capacity, because questions of medical consent relate to participants’ own personal health. Decision-making capacity should be viewed as a continuous function. While the age of the person whose consent is needed should be considered, age alone, from a moral perspective, is not the main determinant of this capacity. (shrink)

Paul Grobstein, Eleanor A. Bliss Professor of Biology at Bryn Mawr College, Pennsylvania, USA passed away Tuesday, June 28, 2011. Since Paul came to Bryn Mawr in 1986, he taught courses ranging from "Introductory Biology" and "Philosophy of Science" to "Evolution of Stories" and "The Brain and Education." Paul founded the Summer Institutes for K-12 Teachers, which brought hundreds of local educators to campus to consider new ways of teaching science and math. He served as chair of the Biology Department (...) and was instrumental in the establishment and success of the Center for Science in Society at Bryn Mawr College. (shrink)

Biologically, pain is neither intrinsically good nor bad, but is a communication mechanism designed to serve organismal ends. Pain for any given person at any given time should be evaluated on the basis of “success” (or not) in serving those purposes. Yet, the physiological, psychological, and cultural complexity of the experience makes moral consideration of pain complicated. This is especially the case with infants in pain. The competence of the infant as a “decision maker” cannot, of course, be assumed. Even (...) if the child “thinks” about pain, an epistemological barrier exists in that the child cannot clearly communicate about the pain experience. Furthermore, any expressions of pain from the child may be necessary for diagnosis. Just coercion criteria provide a means of evaluating when and to what extent pain in infants should be controlled under the authority of surrogate decision makers. (shrink)

This article studies a series of provocative references to Spinoza by Jacques Derrida and Giorgio Agamben. For both contemporary philosophers, the context is discussions of eating, a subject matter that turns out to involve such central issues as subjectivity, nature, ethics, and teleology. Each situates Spinoza in a counter-history of philosophy and suggests that Spinoza constitutes an important resource for contemporary reflections. Through an analysis of the three philosophers' texts about eating, nutrition, and being metabolized, I argue that Spinoza's nonteleological, (...) nonhumanistic conception of nature remains a radical possibility, even in the face of contemporary attempts to think outside the canonical discourses of transcendental subjectivity, technological reason, and teleological ethics. Spinoza's position is, in the end, more uncompromising than that of Derrida or Agamben. (shrink)

Sir Arthur Norrington deserved better of the world than to be known for his table. The Norrington Room, his presidency of Trinity, his long service to the University Press, deserve repeated coverage in the papers. But the only thing they say about him year after year is that he devised the table for comparing the academic prowess of the colleges in the Schools. It is not even true. Long before the Norrington table was first published, when I was an Assistant (...) Tutor in a Cambridge college, I used to see the table which the Tutor drew up each year to show how our college was faring in tripos in comparison with other colleges. And, as a private tutorial check on Schools results, it is a legitimate and useful tool. But, published in the newspapers and made the subject of tea-time conversation in the country, it is a menace and counterproductive to the good things that Oxford should be chiefly concerned to foster. The ontological argument has run for a long time, regularly refuted, regularly re-appearing in a new form. Something can be learnt from its longevity. Its proponents must be on to something, or it would not have survived its many refutations. But equally, it must have been much misformulated, or it would not have seemed evidently fallacious to its many critics. Perhaps it does express a deep philosophical intimation. Certainly it has been taken to prove more than it really can establish. (...) Like many other philosophical arguments it has suffered by being made out to be more rigorous than in the nature of the case it can be. For some philosophers addressing some questions it may have been decisive in leading them to adopt one of the few options open to them: but it is quite inconclusive for others, with different presuppositions or different problems, and cannot be reduced into a valid proof cogent for all comers and compelling them to accept the conclusion it claims to demonstrate. XLRI, in association with a few Tata Group companies, established the XLRI-JRD Tata Foundation in Business Ethics in 1991 to mark their long-standing commitment and contribution to business ethics in India. The foundation seeks to address this by publicly affirming the urgent need for ethics in business and the need to bring about a conducive culture in which it can thrive.

That space and time should be integrated into a single entity, spacetime, is the great insight of Einstein's special theory of relativity, and leads us to regard spacetime as a fundamental context in which to make sense of the world around us. But it is not the only one. Causality is equally important and at least as far as the special theory goes, it cannot be subsumed under a fundamentally geometrical form of explanation. In fact, the agent of propagation of (...) causal influence is electromagnetic radiation. In this examination, the authors find support for a rationalist approach to physics, never neglecting experimentation, but rejecting a simple empiricist or positivist view of science. (shrink)

O objetivo deste ensaio é examinar a proposta de Sandy Goldberg, segundo a qual há divisão de trabalho epistêmico em certos processos de aquisição de conhecimento – ao menos em se tratando de conhecimento testemunhal. Goldberg propõe mostrar a veracidade desta alegação salientando a nossa dependência epistêmica em relação a outros indivíduos, ou mesmo comunidades inteiras. Nós, então, vamos propor o tratamento de um famoso caso tipo-Gettier que, segundo Gilbert Harman, revelaria algumas dimensões sociais do conhecimento. Por fim, nós esperamos (...) tirar algumas lições da explicação oferecida por Goldberg, dentre as quais a mais importante a ser tomada é que, havendo tal divisão de trabalho epistêmico em processos de aquisição de conhecimento, muitas vezes, não são apenas as propriedades epistêmicas do sujeito que determinam a sua posse de conhecimento ou ignorância, de modo que o conhecimento é mais social do que individual em se tratando de uma ampla gama de casos. Context: The past few years have presented us with a growing amount of theoretical research (yet that is often based on neuroscientific developments) in the field of enactive music cognition. Problem: Current cognitivist and embodied approaches to music cognition suffer, in our opinion, from a too firm commitment to the explanatory role of mental representations in musical experience. This particular problem can be solved by adopting an enactive approach to music cognition. Method: We present and compare cognitivist, embodied and enactive (...) approaches to music cognition and review the current research in enactive music cognition. Results: We find that, in general, the enactive approaches to human musicality are capable of explaining the basic relationship between a musical subject and a musical object according to a pre-conceptual and pre-linguistic form of understanding related to bodily motor expertise. This explanation does not rely on on sophisticated forms of representation. Implications: Proponents of enactive music cognition should, in our opinion, focus on providing a consistent explanation of the most basic level of musical understanding. Constructivist content: We hope to invite the constructivist community to engage with the discussions on the intersection between music and enactivism. (shrink)

A change in sense of self is an outcome commonly associated with Buddhist meditation. However, the sense of self is construed in multiple ways, and which changes in self-related processing are expected, intended, or possible through meditation is not well understood. In a qualitative study of meditation-related challenges, six discrete changes in sense of self were reported by Buddhist meditators: change in narrative self, loss of sense of ownership, loss of sense of agency, change in sense of embodiment, change in (...) self-other or self-world boundaries, and loss of sense of basic self. Changes in sense of self could be transient or enduring, positive or distressing, enhancing or impairing. These changes were also given varied appraisals, ranging from insights associated with Buddhist doctrines to psychopathologies such as depersonalization. In this study of practitioners reporting meditation-related challenges, more global changes in sense of self were associated with higher levels of impairment. These results have implications for both Buddhist meditation as well as mindfulness-based interventions. (shrink)

“Towards a Theory of Taxation” is a proper theme for an Englishman to take when giving a paper in America. After all it was from the absence of such a theory that the United States derived its existence. The Colonists felt strongly that there should be no taxation without representation, and George III was unable to explain to them convincingly why they should contribute to the cost of their defense. Since that time, understanding has not advanced much. In Britain we (...) still maintain the fiction that taxes are a voluntary gift to the Crown, and taxing statutes are given the Royal Assent with the special formula, “La Reine remercie ses bons sujets, accepte leur benevolence, et ainsi le veult” instead of the simple “La Reine le veult,” and in the United States taxes have regularly been levied on residents of the District of Columbia who until recently had no representation in Congress, and by the State of New York on those who worked but did not reside in the State, and so did not have a vote. Taxes are regularly levied, in America as elsewhere, on those who have no say on whether they should be levied or how they should be spent. I am taxed by the Federal Government on my American earnings and by state governments on my American spending, but I should be hard put to it to make out that it was unjust. Florida is wondering whether to follow California in taxing multinational corporations on their world-wide earnings. (shrink)

R. and Philip Milton present the first critical edition of John Locke's Essay concerning Toleration, based on all extant manuscripts, and a number of other writings on law and politics composed between 1667 and 1683. Although Locke never published any of these works himself they are of very great interest for students of his intellectual development because they are markedly different from the early works he wrote while at Oxford and show him working out ideas that were to appear (...) in his mature political writings, the Two Treatises of Government and the Epistola de Tolerantia. With authoritative contextual guidance from the editors, this will be an invaluable resource for all historians of early modern philosophy, of legal, political, and religious thought, and of 17th century Britain.
